Terms & Conditions (Algemene Voorwaarden)

These Terms and Conditions govern all offers, agreements, coaching services, sessions, and digital materials provided by BlossomnHeal, operated by Shambhavi Nagaraj. By booking an appointment, making a payment, or accessing our services, you agree to be bound by these terms

1. General & Identity

2. Scope & Nature of Services

1. BlossomnHeal provides personal development coaching, breakthrough facilitation, and self-trust mentorship.

2. Best-Effort Obligation (Inspanningsverplichting): Coaching is an interactive process with no guaranteed specific financial, emotional, or career outcome. BlossomnHeal commits to delivering services with professional care, competence, and diligence. The client remains fully responsible for their own decisions, implementations, and actions.

3. Not Medical or Psychological Healthcare: Services provided by BlossomnHeal are not therapy, psychotherapy, counseling, psychiatric treatment, or medical diagnosis. Coaching does not replace licensed medical or mental healthcare. If you are experiencing acute mental health distress, please consult a registered medical doctor or mental health professional.

3. Bookings, Appointments & Delivery

1. All sessions are booked through Calendly and conducted digitally via Zoom unless agreed otherwise in writing.

2. The client is responsible for having a functioning internet connection, working audio/video equipment, and a quiet, private environment during online sessions.

3. Late Arrivals: If a client arrives late to a Zoom session, the session will still end at the scheduled time to respect subsequent appointments. Time lost due to client delay cannot be made up or refunded.

4. Payments, Invoicing & Pricing

1. Payments and invoices are handled via Mollie B.V..

2. Sessions and packages must be paid in full prior to the start of the scheduled session unless a written installment plan has been formally agreed upon.

3. All prices are listed in Euros (€). Applicable Dutch VAT (BTW) will be specified at checkout or invoice unless the business operates under the Dutch Small Businesses Scheme (KOR).

4. Failure to complete timely payment may result in immediate suspension or cancellation of scheduled sessions.

5. Rescheduling & Cancellation Policy

1. Notice Period: You may reschedule or cancel a session free of charge up to 48 hours prior to the scheduled start time via Calendly or email.

2. Late Cancellations (< 48 Hours): If you cancel or reschedule within 48 hours of your session, 100% of the session fee will be charged or forfeited from your package, as that time slot was reserved exclusively for you.

3. No-Shows: If you do not attend a scheduled session within 15 minutes of the start time, the session is deemed forfeited without entitlement to a refund or replacement.

4. Cancellations by BlossomnHeal: If BlossomnHeal must reschedule or cancel due to illness or force majeure (overmacht), you will be notified as early as possible, and the session will be rescheduled at no additional cost.

6. Cooling-Off Period & Right of Withdrawal (Herroepingsrecht)

1. For consumer clients residing within the EU/EEA, a statutory 14-day cooling-off period applies to online service purchases under the European Consumer Rights Directive.

2. If you request or agree that a session or coaching program begins within this 14-day withdrawal period, you explicitly consent to the immediate performance of the service and acknowledge that your right of withdrawal expires once the session or service has been fully delivered.

7. Intellectual Property & Materials

1. All diagnostic frameworks, worksheets, lead magnets (including The Awareness Ceiling™ Audit), recordings, concepts, branding, and written guides created by BlossomnHeal remain the exclusive intellectual property of Shambhavi Nagaraj.

2. Materials provided are licensed solely for the client's individual, non-commercial use.

3. The client may not copy, distribute, sell, publish, modify, or share session worksheets, frameworks, or recordings with third parties without prior written consent.

8. Confidentiality, Transcriptions & Privacy

1. All personal information shared during sessions will be treated with strict professional confidentiality.

2. Session Transcriptions & Notes: Digital transcriptions, summaries, and private diagnostic notes generated during or after Zoom calls are used solely for the continuity and enhancement of your coaching journey. These files are stored securely and never shared with third parties.

3. Processing of personal data is governed by the [BlossomnHeal Privacy Policy] in accordance with the Dutch AVG / EU GDPR.

9. Limitation of Liability

1. To the maximum extent permitted by Dutch law, BlossomnHeal and Shambhavi Nagaraj are not liable for any indirect, consequential, punitive, or financial damages resulting from your participation in the coaching programs or use of provided materials.

2. Any direct liability of BlossomnHeal shall be strictly limited to the total amount paid by the client for the specific session or coaching package giving rise to the claim.

3. Nothing in these terms excludes liability caused by intent (opzet) or gross negligence (bewuste roekeloosheid) under Dutch law.

10. Applicable Law & Dispute Resolution

1. These Terms and Conditions and all agreements with BlossomnHeal are governed exclusively by Dutch law (Nederlands recht).

2. In the event of a dispute, parties agree to first make a reasonable effort to resolve the issue amicably in good faith.

3. If no resolution can be reached, disputes will be submitted to the competent court in the judicial district where BlossomnHeal is established (District Court of North Holland / Rechtbank Noord-Holland).Schrijf je tekst hier...
